Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") sets out the rules and guidelines for acceptable use of the InvoiceBhai platform and services ("Service") provided by InvoiceBhai Technologies Pvt Ltd ("Company," "we," "us"). This AUP is incorporated into and forms part of our Terms of Service.

By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in immediate suspension or termination of your account without notice or refund.

2. General Principles

You agree to use the Service only for lawful and legitimate business purposes. You shall use the Service in a manner that is consistent with all applicable laws, regulations, and rules, including but not limited to Indian tax laws (CGST Act, SGST Acts), the Information Technology Act, 2000, the Indian Penal Code / Bharatiya Nyaya Sanhita, the Prevention of Money Laundering Act, 2002, and the Digital Personal Data Protection Act, 2023.

3. Prohibited Uses

You shall NOT use the Service for any of the following purposes:

3.1 Fraudulent and Illegal Activities

  • Fake or Fictitious Invoices: Generating invoices for transactions that did not occur, for goods or services that were not supplied, or for entities that do not exist.
  • Inflated or Deflated Invoices: Creating invoices with intentionally inflated or deflated values to evade taxes, claim undue input tax credit (ITC), or deceive any party.
  • Circular Trading or Bill Trading: Using the Service to generate invoices as part of circular trading schemes, accommodative transactions, or any arrangement designed to fraudulently claim GST input tax credit.
  • Tax Evasion: Using the Service to facilitate evasion of GST, income tax, or any other tax or duty.
  • Money Laundering: Using the Service to facilitate money laundering, terrorist financing, or any activity that violates the Prevention of Money Laundering Act, 2002.
  • Identity Fraud:Using another person's or entity's GSTIN, PAN, or business identity without authorisation to generate invoices.
  • Forgery: Altering, modifying, or forging invoices generated through the Service after they have been issued.

3.2 Misuse of the Platform

  • Reverse Engineering: Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or underlying technology of the Service.
  • Automated Abuse: Using bots, scrapers, automated scripts, or any automated means to access, interact with, or extract data from the Service, except through our official API (if provided).
  • Circumvention: Attempting to bypass, disable, or circumvent any security features, rate limits, access controls, or technical restrictions of the Service.
  • Interference: Introducing viruses, malware, or any harmful code into the Service, or attempting to disrupt, damage, or impair the operation of the Service or its infrastructure.
  • Excessive Load: Using the Service in a manner that imposes an unreasonable or disproportionate load on our infrastructure, or that degrades the Service for other users.
  • Resale:Reselling, sublicensing, or redistributing the Service or access to the Service to third parties without the Company's prior written consent.

3.3 Content and Communication Violations

  • Offensive Content: Including defamatory, obscene, threatening, abusive, hateful, discriminatory, or otherwise objectionable content in any data submitted to the Service.
  • Spam and Unsolicited Communication: Using the Service to send unsolicited bulk invoices, promotional content, or spam to third parties.
  • Impersonation: Misrepresenting your identity or affiliation when using the Service.
  • Illegal Goods and Services: Generating invoices for goods or services that are prohibited or restricted under Indian law, including but not limited to narcotics, counterfeit goods, weapons, or stolen property.

3.4 Data and Privacy Violations

  • Unauthorised Data Collection: Collecting, harvesting, or storing personal data of other users or their clients in violation of the DPDP Act or other applicable data protection laws.
  • Data Breach Facilitation: Intentionally or negligently causing or contributing to a breach of personal data.
  • Misuse of Client Data: Using client information obtained through the Service for purposes other than legitimate invoicing and business transactions.

4. Your Responsibilities

You are responsible for:

  • Ensuring that all information entered into the Service is accurate, truthful, and complete.
  • Verifying the legitimacy of all transactions for which invoices are generated.
  • Maintaining the security of your account and immediately reporting any unauthorised access.
  • Ensuring that any person using the Service through your account complies with this AUP.
  • Keeping your GSTIN, PAN, and other registration details current and valid.

5. Monitoring and Enforcement

The Company reserves the right, but is not obligated, to monitor use of the Service for compliance with this AUP. We may investigate any suspected violations and take appropriate action, including:

  • Issuing a warning to the User.
  • Temporarily suspending the User's account pending investigation.
  • Permanently terminating the User's account and deleting associated data.
  • Reporting violations to relevant authorities, including GST authorities, law enforcement, or the Data Protection Board of India.
  • Pursuing legal action for damages caused by the violation.

We may take any of the above actions at our sole discretion, without prior notice, and without liability to you.

6. Reporting Violations

If you become aware of any violation of this AUP by another user or any third party, please report it immediately to us at help@invoicebhai.com or call +91 63877 68346. We will investigate all reports in good faith and take appropriate action.

7. Cooperation with Authorities

The Company will cooperate with law enforcement agencies, GST authorities, and other regulatory bodies in investigating and prosecuting violations of law committed through the Service. This cooperation may include, where required by law or lawful order, sharing User Data and invoice records with such authorities.

8. Consequences of Violation

Violation of this AUP may result in one or more of the following consequences:

  • Immediate Suspension: Your access to the Service may be immediately suspended without prior notice.
  • Account Termination: Your account may be permanently terminated, and all associated data may be deleted after the legally required retention period.
  • No Refund: No refund of any fees paid will be provided in the event of termination for AUP violation.
  • Legal Action:The Company may pursue civil and/or criminal legal action against you for damages, including but not limited to lost revenue, costs of investigation, and attorney's fees.
  • Regulatory Reporting: The Company may report the violation to relevant regulatory and law enforcement authorities.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your violation of this AUP.

10. Amendments

The Company reserves the right to modify this AUP at any time. Changes will be posted on our website (www.invoicebhai.com) and communicated to users via WhatsApp or email. Continued use of the Service after the effective date of any modifications constitutes acceptance of the updated AUP.

11. Severability

If any provision of this AUP is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
